Terms of Service

Welcome to Fiona Read's art business (referred to as “we”, “us” or “our”). These Terms of Service (“Terms”) apply to all purchases made through our Shopify store fionareadart.com (the “Site”), including original artworks, prints, framed prints, and commissioned works. By accessing the Site or placing an order, you agree to these Terms, our Privacy Policy and any other policies referenced on the Site.

Please read these Terms carefully before placing an order. If you do not agree, you must not use our Site or services.

1. Products We Sell

We sell:

  • Original Artworks – one-of-a-kind pieces created by Fiona Read.

  • Art Prints – high quality reproductions of original artworks.

  • Framed Prints – art prints professionally framed and fulfilled by our Australian framing partner, Frames Now.

  • Commissioned Artworks – custom artworks created on request under a separate commission agreement.

2. Ordering & Acceptance

2.1 When you place an order on the Site, you are making an offer to purchase in accordance with these Terms.

2.2 We reserve the right to accept or reject your order at any time for any lawful reason (e.g. product availability, error in price or description, payment issues).

2.3 A contract is formed when we confirm acceptance in writing (e.g. by email) or when your order is dispatched.

2.4 We reserve the right to cancel or refuse any order prior to dispatch if we believe it may be fraudulent, unauthorised, or in breach of these Terms.

3. Pricing, Payment & Taxes

3.1 All prices are listed in Australian Dollars (AUD) and include GST, unless stated otherwise.

3.2 Prices are subject to change without notice, but the price displayed at checkout at the time of your order is the price you will pay.

3.3 Payment must be made in full at the time of ordering using the payment methods provided on Shopify (e.g. credit/debit card, PayPal, Afterpay, etc.).

3.4 If your payment is declined or reversed (e.g. via chargeback), we may cancel your order or recover amounts owed.

4. Shipping, Fulfilment & Risk

4.1 We ship Australia-wide and internationally where available. Shipping options, costs, and estimated delivery times are shown at checkout.

4.2 Framed Prints are fulfilled and shipped by Frames Now (an Australian third-party supplier). Once an order for a framed print is placed, Frames Now will frame and dispatch your item directly to you.

4.3 Delivery Timeframes:

  • Original artworks & prints: Typically dispatched within [the number of business days stated on the website] business days.

  • Framed prints: Allow additional production time for framing (typically [7] business days) before dispatch.

4.4 Delivery times are estimates only. We are not responsible for delays caused by carriers, customs, natural events, or other factors beyond our control.

4.5 Risk in the goods passes to you upon delivery to your nominated address. Title (ownership) remains with us until full payment is received.

5. Consumer Guarantees (Australian Consumer Law)

Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law (ACL)(Schedule 2 of the Competition and Consumer Act 2010).

You are entitled to a replacement or refund for a major failure and compensation for any other reasonably foreseeable loss or damage. If the goods fail to be of acceptable quality and the failure does not amount to a major failure, you are entitled to have the goods repaired or replaced.

These rights are in addition to any manufacturer’s warranties or our own returns policies.

6. Returns, Refunds & Exchanges

6.1 Change of Mind

  • We do not offer refunds for change of mind on original artworks or commissioned pieces.

  • For prints and framed prints, we may (at our discretion) offer an exchange or store credit if you notify us within 5 of receiving the item and it is returned in original, resaleable condition. Return shipping costs are your responsibility.

6.2 Faulty or Damaged Goods

If your item arrives faulty or damaged, please contact us at hello@fionareadart.com within 3 days with photographs of the issue.

  • If the issue is confirmed, we will repair, replace or refund the item in accordance with the ACL.

  • For framed prints fulfilled by Frames Now, we will liaise with them on your behalf to resolve the issue.

6.3 Commissioned Artworks

Due to their custom nature, commissioned artworks are non-refundable except where required under the ACL (e.g. major failure).

7. Commissioned Artwork Terms

7.1 Commissioned artworks are created based on mutual agreement (e.g. size, subject, medium, price). A separate commission agreement or invoice will outline the project details.

7.2 A non-refundable deposit of 35% is required to secure your commission. Work will commence once the deposit is received.

7.3 The remaining balance is payable upon completion, prior to delivery or shipping.

7.4 Minor variations from concepts, sketches, or reference images are to be expected and form part of the artistic process.

7.5 Copyright and reproduction rights remain with the artist unless explicitly transferred in writing.

8. Intellectual Property

8.1 All artworks, prints, images, logos, designs, and content on the Site are protected by copyright and other intellectual property laws.

8.2 Purchasing an artwork or print does not grant you copyright or reproduction rights. You may not copy, reproduce, distribute, modify, or use the artwork for commercial purposes without written permission.

8.3 We reserve the right to reproduce and display images of original and commissioned artworks for marketing, portfolio, or exhibition purposes, unless otherwise agreed in writing.

9. Limitation of Liability

Except to the extent required by law (including ACL):

  • We are not liable for indirect, incidental or consequential loss;

  • Our total liability for any claim is limited to the amount you paid for the relevant product or service;

  • We make no warranties except those expressly stated in these Terms or required by law.

Nothing in these Terms excludes liability for death, personal injury, fraud, or any other liability that cannot be excluded by law.

10. Privacy

Your privacy is important to us. We handle personal information in accordance with our Privacy Policy. By using the Site, you consent to the collection and use of your information as described in that policy.

11. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Victoria, Australia.

If a dispute arises, we encourage you to contact us first to seek a resolution. You may also have rights to pursue complaints through your state consumer protection agency or in a court of competent jurisdiction.

12. Changes to Terms

We may update these Terms at any time. The updated version will be posted on this page with a new “Last Updated” date. Continued use of the Site after changes are made constitutes acceptance of the updated Terms.

Nothing in these Terms excludes, restricts or modifies your rights under the Australian Consumer Law. These rights are guaranteed and apply in addition to any warranty we offer.
